My ford fiesta got hit from behind by a merc 4x4 a couple of days ago. Still waiting for it to be assessed by insurance company. Never been in an accident before and want advice as to whether the car will be written off. Other party has accepted blame and it's going through some company admiral use to settle third party claims. I want to keep the car if possible only had it 12 months. Thanks.

OK - so in your case the other person's insurance is covering costs - right. Fine that a person (Amiral?) is finding a cost and may decide it a total loss or to fix it.

Now you may have some serious disagreement with the determination of what happens. This stuff can vary greatly from place to place but it you are on the ball can get the most compensation for putting you back to where you were before anything happened.

Areas to watch out for and watch out for fine print. "Unseen Damage" and how long you can collect on that. If a new car known to be original or real good shape BEFORE you can fight for original parts vs used or cloned parts. Know many places if body work is more than very simple (doesn't sound like it) that car is tagged as a having been in a wreck and the total value just dropped you can look that up at some site for valuations.

You IMO but may not be the rules are due replacement transportation of the same type while yours is being repaired and other associated costs.

In short the insurance paying will ultimately decide to pay out one price to settle if the core value of the car as it its now plus costs of repair and misc. costs exceed that would much rather take that and pay out once and be done with you then string a more serious accident on for possible more problems later just end it.

Find out what your rights are. You should always be able to choose the place you want it repaired not them so should be seeking that out now,

Rules and regulations do vary from state to state and in different countries....From personal experience in my area.....1st they will send out an adjuster to asses the damage....If the repair costs exceed the valve of the car, then it will be totaled ....Which you think is going to happen???
In the case of totaled vehicles....Say the set value is 10k.....You can take the money and it's over....or you do have the option to "buy back" your car...If you do that.....Then they would cut you a check for say 8k and give you the car back.....I'm just guessing at the numbers....and that is what you would have to look at....if you feel the buy back number is too high, then cut your losses and take the full amount.....

Around here, if you do take the car back and repair it.....It now has what is called a "Salvaged title"...and to legally be on the road it has to pass an inspection...Years ago in this area, you couldn't get full coverage insurance on a car with a salvaged title, just liability coverage.....Plus cars with salvaged titles have a lower blue book valve....

I'm not sure where you are from....but you may want to check with the dept of motor vehicles and insurance companies in your area to find out whats involved in repairing a totaled vehicle and getting it legally back on the road

Many insurance companies will not let you buy it back. They have set procedures for salvage disposal and won't give anyone "first option". That's becoming the standard more than the option these days.

They also want the title to actually change hands, not just remain with the customer so it can be flagged as salvage.
