2010 Chrysler Town and country engine trouble

Hi! We purchased our van at the beginning of January and last Tuesday I had all kinds of trouble when driving into town. Started shaking, lost power steering and power brakes. Finally got it stopped and had it towed to nearby dealership. Engine is not fixable. They said it looked like a spark plug exploded and blew up a cylinder and or piston. mechanics at the Chrysler shop asked if we knew the van had a junkyard engine in it. Of course this was news to us!! Called the dealership we bought from. They said tough lick, you didn't buy a warranty. They then called back 2 hours later having found a warranty that they provided on purchase. We knew nothing about it.

Warranty guy came out and said there was a foreign object in the cylinder. Guys at shop said that was just part of the blown up piston. So, warranty people said you have to tear it down more to prove that. We are currently $500 in to the engine tear down, getting it to where the warranty wants it will put us at $1500 more.

My question is the following. Would you go ahead with testing down for the warranty guys? We will hopefully have a case against the dealership for lemon law (in Indiana BTW) but just want our car fixed for now! It is our only vehicle. So, what would you do if in our shoes? The dealership is back to being jerks to us, so don't think they will be of any help and they claim they didn't know it had a junkyard engine in it.

Oh And one more thing, is there anyway to 100% know it is a junkyard engine? The mechanics said it had marks on the side indicative of a pull, had green antifreeze, and just in general looked twice as many miles as our van, which has around 62000 miles.

speak to an attorney.
they will advise and may be less than your 1500$ option.
Funny things happen when you have a representative - like cooperation communication and options.

My husband contacted a lemon law attorney out of Chicago. Got the best reviews and don't charge at all. Of course, they'd have to take the case. We'll see I guess! He also filled out a form online for our attorney general. Hopefully the dealership starts being cooperative soon. It all is just so sketchy. The junk engine, mysterious warranty, being declined by the warranty people. We are not litigious or paranoid people normally! This while situation has been so crazy. Thanks for the help!

I thought lemon laws only applied to new car purchases not used cars.

From what I can tell, some states have used car lemon laws and Indiana is one of them. I don't really understand them at all, just trying to cover all our bases to figure something out. Because of the circstances we hope the dealer is responsible in some way.

Just about Lemon Laws: All different for different states so look it up (it on the web) what is implied even without disclaimers for the sale of used and what is past limits. I'm in MA and it applies to private and dealer sales a must up to so many model years or miles for MAGOR issues not just anything.
Ex: New just means 3 tries at a safety or problem that makes vehicle unusable. Used by dealer as low as just 30 days up to 90 days for a 5 year old. All is auto exempt by 100K and 10 model years TMK.
It's the only state (MA) that it's ILLEGAL to sell a motor vehicle with words "AS IS" which was considered too vague so seller must state known problems or that problem are known or unknown same meaning different words. Buyer's problem no matter what legally.
Of just a handful of cases heard of it took a YEAR for any settlement! Miles of any use deducted, no allowance for alternate transportation or damage of inconvenience. In short, pretty useless IMO.
The game will be to wear you down and at your expense. A properly done used engine wouldn't void anything if well documented.
No doubt they are exempt for whatever is found for just saying YOU did it or drove it improperly, improper load, use of some kind and you bear all the expense.
YOU almost can't win. Even if a court says you did seller will or could just kick the ball down the road months saying no $$ to settle or a detail to be brought up in six more months - stinks all around. Prepare for that,
