Hi,
I’m hoping someone might be able to help me with a car I’ve recently bought that I wish I hadn’t.

In November my beloved Clio was written off after someone crashed into it while it was parked up in a car park. I got the money from their insurance company and went looking for another car. A friend of the family came with us to look at a couple as he knows a bit about this sort of stuff (I haven’t much of a clue). I needed a car quite quickly to get me to work and back, we went to look at this 2004 Peugeot 206 a few miles from where we live, it was advertised on Gumtree. Our friend checked it over and said there was no disguising that it had been in some sort of bump although it looked ok apart from the dints scratches etc, the seller was open and honest about this although he said it wasn’t him who had it when it crashed, he had only recently gotten it and had replaced the bonnet. Our friend was doing us a massive favour by trekking around with us for days so I sort of felt like I had to find one quickly. I trusted him so we (stupidly) paid £650 for it. I paid for an Hpi check afterward and it claimed the car had been a Cat D write off a few years back and a Cat C only the month before we bought it. So after doing a bit of googling, correct me if I’m wrong, if had only been very recently written off then the seller shouldn’t have had the log book? To make matters all the more confusing, I did a vehicle enquiry check on VOSA’s website and there was no VIC marker on the car, I’ve just received the V5 back from the DVLA and there is nothing at all about the write off on there.

Could it be that whoever owned it when it crashed just didn’t bother to tell their insurance? Or am I missing something?

Anyway we’ve had the car a month now and it’s not running properly, I have to go up any kind of hill in 1st gear, if I go up into 2nd there’s just no power in the accelerator, and it also sometimes cuts out when I’m waiting at a junction or lights etc. I still have the rest of the money from the insurance so I want to sell this and get myself a better car (what I should have done in the first place). So my problem is when I come to sell it, I’ve resigned myself to losing money on it, but do I sell it as a Cat C write off or not? Surely it will look a bit dodgy if they do an HPI and see Cat C but then it says nothing about this on the V5?

Any advice would be appreciated…

Emma - £650 isn't a ton of money for a vehicle anymore here never mind there. From US so can't know all the legal criteria a car must meet to be classified this or that OR here they tag a car as "salvage" such that it essentially losses exact identity forever and any new owner if those are fixed would know in the purchase papers.

Is your problem now that you can't make this car legal to use? Lack of the "accident" history could be avoided here by simply paying for damage with no insurance involved or in a legal problem with an incident where it was documented perhaps.

Is it safe a functional now even if this bad news is in its history? Damage can be fixed and safe again. If that cost exceeds the vehicle's value most wouldn't do it.

If this is rightfully your car now and you can't cancel the sale do have it inspected for it's actual condition to be a safe car and what it would take if not.

Not quite sure just where you stand with this car right now so a little more money may be needed to see if you should fix or take a loss and sell it honestly for what it is,

Wow....thats a bad deal....Hopefully things will work out for you..

I'll just offer a couple of quick thoughts here...

1st.....DON'T ever buy ANYTHING because you feel "pressured" by anyone....I get it, it was a friend and taking along time but then just thank the friend and move on to plan B..... With anything, if it's auto repair or buying a new tv, if the deal is "so good" you can't walk away for 30 minutes to make a decision.....Then that is a sign that maybe this isn't such a good deal after all.....

With your next car, do your homework like you did with this one, only do it BEFORE you buy it, once you buy it's yours.
Also once you find one you are ready to buy, take it to a shop and have a tech put it in the air and do a quick inspection. This won't tell you what is going to break tomorrow but it will tell you what is already broken and you would be surprised what you can see once you are standing underneath the car....

I can't say for over there but over here any private used car say is "as is".....meaning it's up to the buyer to check it out before they buy it and there is no warranty on anything.

As far as selling the car......That is up to you and what you are ok doing & not doing... Over here, unfortunately, the majority would just sell the car without saying anything putting the ball in the sellers court but there is a small minority that woudl be up front about it....of course they probably wouldn't sell their car either.....

Good luck & 1 hope things go better for you.....................and spent the $50 and get the next one looked at before you buy it....
